Et Cetera: Human Trafficking Survivors in Victoria’s Criminal Justice System

Felicity, Gabriela Franich and Cate Read have published an article in the Deakin Law Student Society’s publication, Et Cetera. ‘An Unmet Need: Human Trafficking Survivors in Victoria’s Criminal Justice System’ is an article based on research currently being undertaken by the authors for a Deakin Law School project funded by the Victorian Legal Services Board.

The article examines the concept of the ‘non-punishment principle’ as it is applied to defences for trafficked people who commit crimes due to the fact of their trafficking, and how Australia’s obligations under the Protocol to Prevent, Suppress and Punish Trafficking in Persons Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime (known as ‘the Palermo Protocol’) may be unmet due to a lack of specific legal defences for crimes committed by trafficked people.
